1. 1st For Furniture (2 Go Direct Limited)
specialises in solid wood furniture, along with accessories and lighting
solutions. All for delivery in mainland UK.
BUYING FROM US
2. Ordering 2.1 All orders are subject to
availability.
2.2 On placing your order we will provide you with an
Order document. This will indicate the items ordered and payment total.
2.3 Your order constitutes an offer by you to purchase
the goods specified in it on these terms and conditions. No offer placed by you
shall be accepted by us other than, (a) by acknowledgement issued and
executed by us; or (b) (if earlier) by the dispatch by us of the goods
contained in the order to you, when a contract for the sale and purchase of the
goods on these terms and conditions will be established.
2.4 Due to the difficulty in accurately estimating the
production and delivery timetable since the manufacturer of the products is
located both overseas and in various parts of the UK, you agree that 2 Go Direct
Limited is not liable for any loss or damage that you may incur due to delays
for delivery of the goods.
2.5 In the event of a delay in delivery of your products
you accept that 2 Go Direct Limited will refund your payment only where, (a)
the order was for a standard product and where the products have not been
delivered within 90 days of the date estimated for delivery by 2 Go Direct
Limited, or (b) the order is for a non-standard product and 2 Go Direct
Limited chooses to exercise its absolute discretion in giving a refund where 2
Go Direct Limited deems it to be reasonable.
2.6 You are responsible for measuring and ensuring the
dimensions of the goods that you buy from 2 Go Direct Limited are suitable and
can be accommodated in its intended resting place.
2.7 2 Go Direct Limited will not refund you for failure
to measure furniture which subsequently cannot fit into the intended resting
place.
2.8 Due to the fact that our furniture is handmade, each
piece is likely to be slightly different in measurements, appearance, colour and
finish. Dimensions may differ by up to +/- 3cm from the sizes stated: to avoid
disappointment on the day, please bear this in mind when measuring your space
and ordering your furniture.
3. Delivery 3.1 Some furniture items will require
assembly. This is not the responsibility of 2 Go Direct Limited or 2 Go Direct
Limited's delivery service.
3.2 Delivery of any goods will be to the ground floor of
a building only during the hours of 9:00 a.m. to 5:30 p.m. Monday to Friday.
Delivery to floors other than the ground floor is only by prior arrangement with
2 Go Direct Limited and not its delivery staff.
3.3 2 Go Direct Limited delivery staff endeavours to
deliver goods on a prearranged day. Events outside of 2 Go Direct Limited's
control may, however, affect the ability to deliver goods during this time and 2
Go Direct Limited cannot be responsible for any delay arising in this manner.
3.4 Risk or damage to or loss of the Products shall pass
to you upon delivery.
3.5 If you order more than one product, you accept that 2
Go Direct Limited may wait until all items are available before arranging for
delivery of the products to you.
3.6 You accept that if you are not present to accept
delivery during the prearranged time you will be charged for delivery and you
will not be entitled to a refund if you are not present to accept delivery.
3.7 You are responsible for ensuring that there is
adequate delivery access to enable 2 Go Direct Limited's delivery staff to
deliver the products. If 2 Go Direct Limited's delivery staff are unable to
deliver the products due to inadequate or restricted access you will pay the
delivery charges both to your property and from your property back to 2 Go
Direct Limited's premises.
3.8 Delivery to the Mainland UK is free of charge,
subject to the minimum order value of £450 being met, unless 3.6 and 3.7 above
are applicable, in which case you will be charged £90 in order to re-locate the
item back to 2 Go Direct Limited's Premises.
3.9 For orders to be delivered to outside of mainland UK,
2 Go Direct Limited will deliver free to a mutually agreed mainland GB address,
(e.g. a port). Onward shipping from that point is the responsibility of the
Buyer.
4. Pricing 4.1 Our prices include VAT.
4.2 Our prices and other relevant charges are reviewed
periodically and you should review the rates before placing an order.
GENERAL
5. Cancellation and Returns Policy 5.1. All risk in
the goods shall pass to you when the goods are taken from our vehicle at your
address.
5.2 If for any other reason you are unhappy with any
item, please return the item(s) within 7 days of receiving the goods. Providing
the item(s) is still in a completely saleable condition and in their original
packaging, we will issue a refund.
5.3 Goods purchased at a discounted price are sold "
as
seen"
and cannot be returned.
5.4 Your statutory rights to a refund of the purchase
price for goods that are not of satisfactory quality are unaffected by these
terms and conditions.
5.5 Goods will not be exchanged or a refund given unless
a proof of purchase from 2 Go Direct Limited is produced.
5.6 The cost of returning goods is your responsibility
and the item(s) are your responsibility until they arrive at 2 Go Direct
Limited's Premises. We therefore recommend using a recorded delivery service for
returns.
5.7 You can cancel an order at any time up to 7 days
after the item has been delivered.
6. Liability 6.1 Nothing in these terms and conditions
shall exclude or limit our liability for (i) death or personal injury caused by
negligence (as such term is defined by the Unfair Contract Terms Act 1977); (ii)
fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability
which cannot be excluded or limited under applicable law.
7. Governing Law and Jurisdiction 7.1 These terms and
conditions shall be governed by and construed in accordance with English law.
Disputes arising in connection with these terms and conditions shall be subject
to the exclusive jurisdiction of the English courts.
8. Miscellaneous 8.1 You may not assign, sub-license
or otherwise transfer any of your rights under these terms and conditions
9. Data Protection 9.1 To comply with the Data
Protection Act 1998 we are required to inform you that we have recorded your
name and address on our computer system for the sole purpose of processing your
order. Please let us know if you object to us keeping this information by
contacting Customer Services and we will unsubscribe you at any time.
9.2 We will keep you up to date with our news and offers
only if you have opted to receive this.
9.3 Your name and address will not be given or sold to
any 3rd parties.
9.4 You have the right to access details of the personal
information we are holding and to correct any discrepancies in that information.
In accordance with the applicable Data Protection laws, we reserve the right to
charge an administrative fee in respect of such requests. Given the nature of
the information you are seeking access to, we are entitled to request
identification from you before dealing with any requests of this nature.
9.5 Should you wish to access your personal information,
please confirm in writing to us. |
